Vacation Formation Travel Agency – Terms & Conditions
By submitting this form or booking travel services with Vacation Formation Travel Agency (“VFTA,” “we,” “us,” or “our”), you acknowledge and agree to the following terms:
1. Role of Vacation Formation Travel Agency VFTA is an independent travel agency acting solely as an intermediary between clients and third-party suppliers (airlines, cruise lines, hotels, tour operators, and other travel providers, collectively “Suppliers”). We do not own or operate these suppliers and are not responsible for their acts, omissions, service quality, or failure to deliver services. All Supplier terms, policies, and agreements apply.
2. Client Responsibility You are responsible for: Providing accurate personal information for all travelers. Reviewing all confirmations, invoices, and travel documents upon receipt.Verifying passports, visas, vaccinations, and entry requirements for all destinations and connecting points. Many countries require passports valid for six months beyond entry. Some deny entry for criminal convictions or require notarized parental consent for minors. Reviewing U.S. Department of State travel advisories at travel.state.gov and following safety guidance. Understanding all safety, health, political, and security conditions at your destinations. VFTA is not responsible for denied entry, delays, or other travel issues caused by incomplete, inaccurate, or outdated traveler information.
3. Vaccinations, Health, and COVID-19 Regulations Travelers assume responsibility for compliance with all health and vaccination requirements imposed by Suppliers or governments, including but not limited to COVID-19, other epidemics, or pandemics. This includes pre-departure testing, health affidavits, screenings, face coverings, and quarantines. We recommend regularly checking: International government regulations: IATA Travel Centre U.S. Department of State advisories: travel.state.gov Supplier-specific rules: visit each Supplier’s official website for up-to-date policies. We are not responsible for additional costs or denied travel due to changing health regulations.
4. Fees and Payments: All planning, research, change, and administrative fees charged by VFTA are non-refundable. Supplier fees, deposits, or payments are subject to Supplier policies. Payments must be made according to your invoice. Delays may result in booking cancellation or additional charges.
5. Price Changes and Supplier Adjustments: Prices may change after booking due to Supplier adjustments or government-imposed fees.You authorize your payment method to be charged for these adjustments. Supplier contracts govern cancellations, changes, and refunds. VFTA does not guarantee refunds or price protection. Clients must review Supplier terms carefully, as they may impose restrictions or penalties independent of VFTA.
6. Travel Insurance: VFTA strongly recommends purchasing comprehensive travel insurance, including: trip cancellation, interruption, medical coverage, and emergency evacuation. Standard policies may exclude epidemics, pandemics, or travel to restricted areas. Cancel-For-Any-Reason (CFAR) coverage is optional but provides broader protection. VFTA is not responsible for claim denials, financial losses, or decisions not to purchase insurance.
7. Force Majeure: VFTA is not liable for delays, cancellations, or additional costs due to: Acts of God, natural disasters, strikes, civil unrest, terrorism, epidemics, pandemics, government actions, or other events beyond our control.
8. Minors and Guardianship: Clients booking for travelers under 18 must ensure parental or legal guardian consent. VFTA is not responsible for issues arising from travel with minors without proper documentation or consent.
9. Liability and Indemnification: VFTA is not liable for personal injury, illness, property damage, or death, including any losses incurred during travel. You agree to hold harmless and indemnify VFTA from any claims, lawsuits, or damages arising from your travel arrangements. This includes claims arising from Supplier failure, third-party acts, or unforeseen events.
10. Credit Card Use and Payment Protection: Using a credit card may provide additional protections under the Fair Credit Billing Act. If VFTA is the merchant of record, our role is solely to collect and remit funds. Your sole recourse for Supplier failures is directly with the Supplier. Chargebacks against VFTA are prohibited for Supplier-related issues.
11. Refunds and Cancellations: All cancellations are subject to Supplier rules. Fees, deposits, and payments may be non-refundable. VFTA will attempt to assist with Supplier rebooking where allowed, but cannot guarantee success or refunds.
12. Documentation, Compliance, and Communication: Clients must provide accurate travel documentation. You authorize VFTA to share information with Suppliers to secure travel arrangements. VFTA may communicate via phone, email, or text regarding bookings or travel alerts.
13. Claims, Disputes, and Governing Law: Claims must be submitted within 30 days of travel completion. Legal action must be filed within one year of the incident. All disputes shall be governed by the laws of Massachusetts, exclusively in the courts of Wakefield, MA. By booking with VFTA, you consent to this jurisdiction.
14. Acceptance of Terms: Acknowledgment: By signing below, you acknowledge and accept these Terms & Conditions as of the date and time of submission.
By submitting this form, making payment, or requesting services, you:
1. Confirm you are 18 years or older.
2. Accept these Terms & Conditions on behalf of all travelers.
3. Agree that you have read, understood, and will comply with all requirements listed herein.
